From Civility to Compassion: Redefining Professionalism in the Legal Profession
In an article by Donald Blackwell published in Attorney at Work, the author argues that while the legal profession’s long-standing push for civility has been well-intentioned, it is no longer sufficient. For more than two decades, bar associations, courts, and legal educators have promoted rules and codes designed to curb rude or abusive conduct. Blackwell emphasizes that lawyers routinely carry unseen burdens, including depression, anxiety, burnout, and substance abuse. According to the article, embracing what he calls “compassionate professionalism” requires education about the warning signs of mental illness and a willingness to confront persistent stigma. Learning to distinguish fact from fiction around mental health, he writes, enables lawyers to better support colleagues and themselves. This education, in turn, allows firms and individuals to respond more thoughtfully rather than defaulting to silence or discomfort.
A central theme of the piece is the need to “step into the awkward silence.” Blackwell urges legal professionals to pay closer attention to behavioral changes in colleagues and not to accept perfunctory assurances when concern is warranted. He suggests that simply noticing, acknowledging, and offering to listen can make a meaningful difference for someone who is struggling, though he does not claim this ensures any specific outcome.
Professionalism should not stop at enforcing decorum; it should model kindness, empathy, and respect across all firm relationships. Blackwell concludes that committing to this broader, more humane vision of professionalism strengthens not only lawyers’ effectiveness, but also the health and sustainability of the profession itself.
