The 2024 eDiscovery Unfiltered report highlights key industry trends: 49% of participants anticipate an increase in litigation matters, while 71% have observed rising data volumes. To stay ahead, Kaplan says that eDiscovery professionals must proactively anticipate client needs and deliver unexpected value.
These challenges are particularly pronounced in antitrust matters, where strong relationships with regulators are crucial. Antitrust law firms must stay ahead of regulatory developments, such as the latest Hart-Scott-Rodino rules, and align their expertise, technology, and talent to maintain a competitive edge.
AI is also transforming eDiscovery, with 72% of firms already using it for tasks like summarizing data, identifying privileged documents, and generating privilege logs. This trend is expected to accelerate in 2025, reinforcing the need for firms to integrate AI thoughtfully and strategically.
