While witness testimony has long been a staple in determining fault, it is often unreliable or unavailable. In contrast, footage from traffic cameras at intersections and along highways is providing a consistent and objective account of how accidents occur. For law firms handling personal injury or liability cases, Gasparian says understanding the capabilities and limits of this evidence is increasingly essential.
Traffic cameras serve multiple functions, from traffic management to law enforcement and public safety. The article cites programs like Caltrans’ Bay Area initiative and Governor Newsom’s Pacific Coast Highway speed camera rollout, which underscore the state’s growing reliance on automated monitoring. These devices include red light, speed, and school bus cameras, each offering varying degrees of visibility and evidence-gathering capabilities depending on the incident in question.
The primary value of traffic camera footage lies in its objectivity. Unlike witness statements, video recordings are immune to bias, faulty memory, or emotional interference. This makes them especially potent in cases involving disputes over fault, or hit-and-run scenarios where the at-fault driver cannot be easily identified. In many instances, the footage can reveal key contributing factors such as speeding, failure to obey traffic signals, or hazardous road conditions.
However, traffic camera evidence is not without limits. Most cameras operate on a triggered basis or record brief clips, and they typically only capture exterior views. Additionally, footage retention periods are short—between 30 and 90 days—making timely requests critical.
